For more than ten years, the Elementary and Secondary Education Act (ESEA), currently known as "No Child Left Behind," has required primary language assessment of English learners for AT LEAST the first three years of enrollment in U.S. schools.
For at least 33 years, the federal government has recognized the inherent unfairness in testing an immigrant student in a language in which that student is not academically competent.
At the present time, ten California school districts and several community-based organizations are suing the state of California for failing to meet the home language assessment requirement under NCLB.
